Terms of Service
These terms apply when you browse Paintacles, create an account or place an order. Please read them before you buy. By creating an account or placing an order you agree to them.

1. Who we are
Paintacles (“we”, “us”) sells original, seasonal designs on finished products such as apparel, blankets, mugs, prints and ornaments, through this website.
Our address is No 7 Ajigbona Street, Modakeke, Osun 220266, Nigeria.
2. Your account
You need an account to place an order. There is no guest checkout.
Give us accurate details and confirm your email address before you check out. Keep your password private and tell us straight away if you think someone else has used your account. You are responsible for what happens under it.
From your account settings you can see which devices are signed in and sign them out, download your data, or delete your account at any time. What deleting an account does is described in our Privacy Policy.
You must be old enough to make a binding contract where you live to place an order. If you are younger, a parent or guardian must place the order for you.
3. Our products
Every product is made for you after you order it, by a print and fulfilment partner. Because each item is made to order, small differences in colour, placement and size from the images on this site are normal. Photos and mockups are a guide to how a design looks, and your screen settings can change how colours appear.
We take care to keep descriptions, sizes and availability accurate. If a product turns out to be unavailable, or a listing contains a mistake, we will tell you and you can cancel the affected order for a full refund.
4. Prices, currencies and taxes
Prices are in US dollars, and are also shown in other currencies when the currency switcher offers them. Converted prices use an exchange rate that we set and update, so the same product can cost slightly more or less in another currency from one day to the next.
The currency, and the rate used, are fixed on your order when you place it. Your bank or card provider may add its own conversion fees, which are between you and them.
Shipping is added at checkout from the items and the destination. Your order summary shows the items, any discount, shipping and any taxes before you pay, and the total you see is the total you pay.
If we find a pricing error after you order, we will tell you, and you can cancel the order and be refunded in full.
5. Placing an order and paying
Your order is an offer to buy. A contract is formed when your payment is confirmed and we send you an order confirmation email. We may decline or cancel an order, for example if a product cannot be made or shipped to your address, if we suspect fraud, or if a listing or price is wrong. If we cancel an order you have paid for, we refund you in full.
Card payments are handled by our payment provider, Flutterwave. Your bank may ask you to confirm a payment, for example with 3D Secure, a PIN or a one-time code. We do not store your full card number or security code. If you choose to save a card, we keep a token that lets you pay with it again, and its last four digits so you can recognise it. You can remove a saved card in your account at any time.
6. The production hold and cancelling
After you pay, your order waits for a short production hold before it goes to print. The length of the hold is shown at checkout and on your order page. Until it ends you can cancel from your order page, and we refund the full amount automatically.
A gift order can be cancelled for a full refund for longer, until it goes to print, because we add the gift message by hand first.
Once an order has gone to print it can no longer be cancelled, because production starts straight away. If there is a problem you can still ask for a refund, as described in Returns and refunds. An order that has not been paid can be cancelled at any time and nothing is charged.
7. Delivery
We ship to the countries offered at checkout. Delivery times, costs and what to do when something goes wrong are set out on our Delivery page, which forms part of these terms.
Delivery dates are estimates, not promises. Please give a complete and correct address: we cannot change an address once an order has gone to print, and if a parcel comes back because the address was wrong or incomplete we may ask you to cover the cost of sending it again.
Risk of loss or damage passes to you when the order is delivered to the address you gave us.
8. Refunds and your rights
If your order arrives faulty, never arrives, or you change your mind, you can ask for a refund from your order page. We review each request and email you our decision. Returns and refunds explains how this works.
Nothing in these terms limits any right you have under consumer protection law where you live that cannot be limited by agreement.
9. Gift orders
You can mark an order as a gift, add a message, and give the recipient's name and email address. We use these only to make the gift, to add your message, and to send the recipient one email, about a day after delivery, asking whether the gift arrived. That email contains no prices, order number, address, message or sender name.
Please make sure you may share the recipient's email address with us and that your message is lawful and not abusive. We can decline a message that is not. How long we keep gift details is explained in our Privacy Policy.
10. Discount codes, rewards and promotions
Discount codes, rewards and promotions apply on the terms shown with them, such as a minimum order value or an end date. They have no cash value, cannot be exchanged for money, and cannot be combined unless the offer says they can. We can change or withdraw an offer at any time, but not for an order you have already placed with it applied.
If an offer is misused, for example by opening several accounts to claim it more than once, we may remove the discount or cancel the order.
11. Reviews
Customers who have received an order can review the product. A review is shown with your first name and the first letter of your last name. By posting one you give us a free, non-exclusive licence to show it on this site.
Reviews must be honest, about the product, and your own. We can decline or remove a review that is abusive, unlawful or misleading, or that contains personal details. If you delete your account, your reviews stay on the site under the name “Verified buyer”.
12. Designs and intellectual property
The designs, artwork, text, photographs, logo and look of this site belong to Paintacles or its licensors and are protected by copyright and other laws. When you buy a product you own that product. You do not get any right to copy the design on it, or to reproduce it for sale.
You may not copy, resell or republish our designs, images or content, or use automated tools to collect content from this site, other than the way ordinary search engines do.
13. Using this website
When you use this site you agree not to:
- break the law or infringe anyone else's rights
- try to reach accounts, systems or data that are not yours
- interfere with the site or its security, or overload it with automated requests
- use someone else's payment method without their permission
- give us false information
We may suspend or close an account that breaks these terms, and will tell you why where we can.
14. Print and fulfilment partners
Products are made and shipped by independent print and fulfilment partners, including Printify, who produce and deliver them on our behalf. To make and deliver your order we share the details they need: your name, your delivery address, your phone number if you gave one, the items ordered and, for a gift, the message. They also handle that information under their own privacy terms. We remain responsible to you for your order.
15. Availability of the site
We work to keep the site available but do not promise that it will always be uninterrupted or free of errors. We may change, pause or remove parts of it, for example for maintenance.
16. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for lost profit or business, or for delays and failures caused by events outside our control, such as carrier or customs delays, strikes, weather, or failures of the internet or of payment networks.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow us to exclude or limit.
Subject to that, our total liability to you for any one order is limited to the amount you paid for it.
17. Changes to these terms
We may update these terms, for example when we add features or when the law changes. The date at the top shows when they last changed. An update applies to orders placed after it. An order you have already placed stays under the terms that applied when you placed it.
18. General
If part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms to someone else without our agreement. These terms, with the pages they refer to, are the whole agreement between you and us about your use of the site and your orders.
